Mark heads up the Private Litigation team at Freeths LLP. He has over 20 years’ experience in the field of contentious trust and probate litigation and has acted in many high value and complex trust/probate disputes including several with an international element.
He has extensive experience in contentious trust and probate litigation,including claims under the Inheritance Act, will challenges and trustee removal applications. Mark is also appointed by the Court to act as an independent replacement trustee/administrator in numerous contested estates including high value estates of up to £80 million.
A recognised leader in his area, Mark is also a qualified mediator with a proven track record of resolving complex trust and probate disputes. Throughout his career he been involved in over 300 mediations and brings a practical and common sense approach to even the most complex litigation.
Mark is a member of the following organisations:
- Member of the ACTAPS organising committee and has also completed the ACTAPS Contentious Trusts and Probate Associate Membership Course that is operated in conjunction with the College of Law.
- Member of the Professional Negligence Lawyers Association (PNLA).
- Affiliate member of the Society of Trust and Estate Practitioners (STEP).
- Panel Member of the Association of Midlands Mediators and now sits on their organising committee as secretary.
Mark also delivers training at various events nationally to practitioners in the area of contested trust and probate and private client work including to local law societies.
Mark is a Legal 500 Leading Practitioner who “commands universal respect in this area”, and is described as “one of the best litigators outside of London” (Chambers and Partners 2018).

Robert Hill is a Senior Associate with 8 years’ experience in the area of private wealth disputes.
Robert’s case load primarily focuses on disputes concerning estates, land, probate and trusts. He has dealt with a number of property disputes (including jointly owned property) and he has a busy caseload in relation to disputed estates, lifetime gifts and disputed trusts.
Robert deals with all types of inheritance and lifetime disputes, including will challenges, executor/trustee removal, Inheritance Act claims, contentious Court of Protection applications and deed interpretation challenges. Robert also advises clients regularly in relation to trusts of land, including claims brought under the Trusts of Land and Appointment of Trustees Act 1996, and disputes over residential properties.
Robert has completedthe ACTAPS Contentious Trusts and Probate Associate Membership Course.
Max Orbach has recently joined the team from Russell Cooke in London and is based in the firm’s Birmingham office. Max specialises in contentious trust and probate cases, and has experience in handling complex cases, including cross border disputes and multi million pound estates.
Max has worked in a number of complex and high value cases, ranging from high value claims brought under the Inheritance Act to claims seeking to realise beneficial interests in land under the Trusts of Land and Appointment of Trustees Act 1996.
